Courts dismiss claims against Quadrant Homes

The Washington State Court of Appeals recently affirmed the dismissal of mold claims against Quadrant Homes.  Plaintiff’s claims were based on oft-repeated allegations of a conspiracy to hide widespread mold problems in Quadrant homes.  These claims have now been dismissed in their entirety.

This case was brought by a homeowner who had purchased a used Quadrant home from another family.  Four years after moving in, the plaintiff discovered that the dryer was not vented properly.  Plaintiff called Quadrant’s customer service department.  Although the plaintiff had not purchased the house from Quadrant, and the house was more than seven years old, Quadrant reimbursed the plaintiff for the repairs to the vent and for the cost of a new dryer.  Quadrant also offered to remediate any moisture problems caused by the improper venting.  Plaintiff rejected Quadrant’s offer and chose to file a lawsuit instead. The trial court dismissed the lawsuit for lack of evidence and the Court of Appeals has now affirmed.  Both courts agreed that the plaintiff had failed to produce evidence to support any of the claims, which included alleged violation of the Consumer Protection Act, fraud, misrepresentation and outrage.  Both courts analyzed each of these claims and found that plaintiff had not proved a single one.


Similar claims filed by a few other homeowners are still pending before the Washington State Supreme Court.  Based upon the information we have been able to collect concerning those homes, we believe those claims to be similarly unfounded.

While we will continue to defend the lawsuits that have been filed against us, and we are pleased that this one is now dismissed, we believe that the most positive aspect of this story is the prompt and effective response of Quadrant’s customer service department. The plaintiff did not purchase the home from Quadrant, and Quadrant had no obligation to make repairs. Nevertheless, our customer service team acted without hesitation. This is an example of why the Quadrant customer service department is considered to be the finest in the region. It also helps explain our customers’ high level of satisfaction with their Quadrant Homes.
